Our Approach to Environmental Permitting March 2013

Introduction
The Environmental Permitting (England and Wales) (Amendment) Regulations 2013 were made on
the 20 February and came into force on 27 February. These Regulations transpose the
requirements of the Industrial Emissions Directive (IED).

Environmental Permitting

The implementation of the Directive means that;

• Anyone seeking a permit for a new activity which is covered by the IED will be an
‘industrial installation’ and need to comply with IED.
• All existing IPPC Installations will be subject to IED from 7 January 2014. We are
currently considering how we bring our existing permitted sites under IED.
• A significant number of existing activities are newly brought into installation permitting.
For all existing waste operations that will be newly subject to IED this permitting will need
to be done by 7 July 2015. This will depend on whether operators will continue to operate
above or below the IED threshold capacity limit. We will let the waste sector know what
this means for them and what changes may need to be made during the latter part of
2013.

Standard permits

We have provided some new IED installation standard rules and associated risk assessments that
can be used for new or existing waste activities that have come into the scope of IED. These are
listed below. They are available and can be applied for now.

We have also provided new waste operation standard rules for new activities that fall under the IED
threshold.

Note: New applicants cannot now apply for the old waste operation rules where they exceed IED
thresholds.

The new rules are listed below.

• Standard rules SR2012 No3 – Composting in closed systems -Waste Operation (capacity
no more than 75 tonnes/day)
• Standard rules SR2012 No4 – Composting in closed systems -Part A Installation (capacity
over 75 tonnes/day)
• Standard rules SR2012 No7 -Composting in open systems -Waste Operation (capacity up
to 75 tonnes/day)
• Standard rules SR2012 No8 -Composting in open systems -Part A Installation (capacity
over 75 tonnes/day)
• Standard rules SR2012, No9 – Part A installation -On-farm anaerobic digestion facility
including the use of the resultant biogas
• Standard rules SR2012, No 10 -Waste Recovery Operation
On-farm anaerobic digestion facility including the use of the resultant biogas
• Standard rules SR2012, No11 -Part A installation -Anaerobic digestion facility including
the combustion of the resultant biogas
• Standard rules SR2012, No12- Waste Recovery Operations- Anaerobic digestion facility
including use of the resultant biogas
• Standard rules SR2012, No13 – Part A installation – Treatment of incinerator bottom ash
(IBA) (capacity over 75 tonnes/day)

If you are making an application for a bespoke installation permit you should talk with your local
Environment Agency officer about the applicable bespoke (Tier 3) OPRA charge.
